This section of powertik (hereinafter, the Platform) contains the conditions that you must accept if you want to contract any of the products or services that we offer on our Platform. Our Platform allows you to purchase tickets for different types of events organised by numerous organisers as well as different products associated with the events or artists (for example, artist merchandising, products associated with the activities carried out, such as books, CDs, etc.). In this document, and unless one of them has some particularity regarding their contracting, we will refer to all the products that you can buy on the Platform as Tickets or Products.
In case you want to obtain general information regarding our Platform or regarding our Privacy Policy, we recommend reading these other sections: Legal Notice and Cookies and Privacy Policy that you can find at the end of the document.
We hope you agree with everything we say here and in the other legal documents; If not, we are sorry but you will have to stop browsing our website and you will not be able to use our service. In that case, do not hesitate to contact us to discuss any of the points that are collected here.

Basic aspects of the Platform
Before buying tickets, it is important to read the Purchase Conditions carefully in order to be sure that the Platform offers what you are looking for and that you agree with the conditions of sale that we offer.
These Purchase Conditions are available to the buyer before making the purchase and must be expressly marked to make the purchase.
By checking the option "I have read and accept the Legal Conditions" you agree to accept the following terms and conditions. Any new feature or tool that may be added to the current service will also be subject to the Terms and Conditions of Purchase, although these new conditions will only apply to Products that you have already purchased if they offer you more advantageous options.
The reading and acceptance of these Purchase Conditions is a necessary condition for the use of the Platform’s services. These Purchase Conditions govern the relationship of the buyer of the Products (hereinafter, the "Buyer") with the seller of the Product (hereinafter, the Organiser) and with crocantickets SL (hereinafter, "the Platform") in our role as intermediary. crocantickets SL is an entity domiciled at Henri Dunant, 15-17 - 28036 (Madrid) with NIF B87004933. As a buyer, you acknowledge that you have sufficient capacity to contract, have read and understood these Platform Purchase Conditions and accept them.
What options does the Platform allow?
Through our Platform you can purchase all those Tickets and Products offered by the Organisers registered on the platform. From the platform we offer a space where you can easily access different Events as well as the Products associated with them. The Platform only offers you a system in which you can access the Events in a unified way and you can buy the Tickets, in case you have questions about the purchase process, we recommend that you contact us by email hello@powertik.com since we are the technological platform that makes it possible.
You must bear in mind that we do not organise the Events nor do we establish the prices or the conditions of access to them, so if your question or comment is about a specific Product or Ticket, we recommend that you contact the Organiser, since they will be able to offer you all the information first hand.
In any case, we are at your disposal and we will be happy to assist you and act as an intermediary between you and the organiser of the event.
How to buy Tickets or Products through the Platform?
If you are interested in purchasing Tickets for an Event, you must register for it; for this you must read the specific characteristics of it carefully and agree with them before buying the Tickets. We detail below the different phases of the process of registration and purchase of Tickets:
Select the type and number of corresponding Tickets and/or Products and click "Buy”;
Enter the personal data requested by the Organiser;
Accept the purchase conditions and click on "Complete Purchase" after which you will be redirected to the payment gateway;
Complete the payment details;
You can save your ticket in 2 ways:
As soon as you make the payment, we will show you a page with a button indicating "download tickets". By clicking on the button you will download the Ticket to your computer at that moment.
You will receive the corresponding Tickets in the email provided.
This document will be at all times the proof of purchase, in which the data of the Organiser is collected so that you have their details and you can go directly to them in case of incidents of any kind and the link with these conditions of purchase so that you always have them at your disposal.

Our customer service team will answer in the fastest and most efficient way possible, we always respond to all cases and we try to streamline communication between the buyer and the developer to achieve a resolution as quickly as possible in all necessary cases.
In any case, you guarantee that the information you provide us is true and you are responsible for notifying us of any modification or update thereof. Therefore, you will be solely responsible for responding to false or inaccurate information that you provide and for the data that you provide in your relations with us, other users and, in particular, with respect to the Organisers.
Suspension, substantial modification, or cancellation of an Event
An event will be understood to be suspended, substantially modified or cancelled if the organiser itself communicates said suspension, substantial modification or cancellation or if it is demonstrable through reliable means that it has been so. In this case, the Buyer will receive from the Platform the refund of the total price paid for their ticket (management fees included) within a maximum period of 10 days from the communication of the organiser or from the Platform acknowledging verifiable evidence of the situation.
The refund will be made to the checking account associated with the card used by the buyer in the ticket purchase process. The Buyer will not have to take any action since it will be the Platform itself that will proactively carry out said return. However, we will be happy to answer customers who write to or call us asking about this case.
Except in the case that the purchase has been processed through a payment gateway owned by the promoter and not by the Platform. In this case, the organiser of the event will be in charge of processing said return. If this is the case, the buyer is notified before making the purchase that the purchase will be made through a payment gateway that does not belong to the Platform but belongs to the organiser of the event.
So that the buyer knows at all times who the organiser of the event is, the platform makes this information available to them on the event page and also in the legal conditions of the purchased ticket.
On the other hand, to confirm the holding of the event, the Platform makes available to the client both the different communication channels and an email to leave comments about the event (this message is sent approximately 24 hours after the event is held, providing that the the promoter has not of his own free will marked the desire not to send said email to collect feedback).
Return Policy
Those who attend shows and recreational activities have the right to watch the show or participate in the recreational activity. They also have the right to ensure that said events take place in their entirety, according to the manner and conditions in which they have been advertised. Users will be entitled to a full or partial refund of the amount paid by the locations, in the event that the show or recreational activity is suspended or substantially modified, except in those cases in which the suspension or modification occurs once the show or recreational activity has started due to force majeure. All of this is without prejudice to any claims that may be made in accordance with applicable civil and commercial regulations.
Regarding the right of withdrawal as a consumer, for informational purposes only, we indicate that the applicable regulations, specifically article 103 section l) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of The General Law for the Defense of Consumers and Users and other complementary laws specifically excludes the supply of services related to leisure activities from the right of withdrawal.
So that the buyer knows at all times who the organiser of the event is, the Platform makes this information available to them on the event page and also in the legal conditions of the purchased ticket.
Getting off the Platform
You can request to unsubscribe from our Platform at any time by sending us an email to hello@powertik.com and we will process it as soon as possible. We will not ask you for justification to carry out the effective cancellation, although we do reserve the right to ask you the reasons for said cancellation for statistical purposes and to improve the service. In any case, before doing so you must take into account that:
You do not have any Ticket and/or Product purchase processes open.
You must bear in mind that we will delete all the data associated with your account and if you later decide to become part of our Platform again, your new profile, even if it is associated with the same email account, will start from scratch.
Customer Service
We offer you Customer Service through our help system. You can access the help system by clicking on the “Help” button at the top of the page. Here we are at your disposal so that you can tell us all the doubts that you have in relation to the Platform and the service that we provide through it.
Customer Service is limited to the Ticket and Product sales service and the Platform, without being able to answer questions about the event itself, admission policy, press, etc., since we do not have this information and so that the resolution of your query is as agile as possible, you should contact the Organiser directly.
In all cases, the Customer Service will be available at the following times (Irish time):
Monday to Thursday (excluding bank holidays): from 9am to 5p.m.

Saturdays: from 4pm to 10pm

Subscription to the newsletter
When making the purchase you can check the box "I want to subscribe to the Newsletter". In that case, you give us your permission so that both we as a platform and the organiser of the event for which you are buying tickets can send you communication and promotional material.

I.- WHAT IS powertik?
powertik is the platform dedicated to the creation of tools that facilitate the organisation and participation in events of different types, through the Platform we wanted to offer both a simple way to purchase tickets for events and provide event organisers with a useful and creative tool to organise and sell tickets for your events.
For this reason, through the Platform, you can have two types of roles: event organiser (including ticket sales) and ticket buyer. In other words, you have different interaction options on the Platform, the characteristics of each one of them are detailed in our Contract Conditions.
II.- CAN I BUY TICKETS WITHOUT REGISTERING?
If you do not register on the platform, you will only be able to buy tickets for the different events organised through the platform. If you want to organise an event, you need to register on the Platform. This section of the Platform only regulates the generic use of our platform, since the specific terms for both the purchase of tickets and the organisation of events will be provided to you in the Contract Conditions. You have the possibility to print this document and if you have any questions, we make our email address available to you.
There is also the possibility that a promoter adds their own legal conditions to your event.
III.- AS A NON-REGISTERED USER, WHAT DO I COMMIT TO?
The mere access to the Platform makes you an unregistered user of it, therefore, as we have already mentioned, by browsing the Platform you are accepting, without reservation, this Legal Notice.
In order to respect the platform and all its users, you agree to the following:
Use the Platform, its services and the contents offered respecting the law, morality, good customs and public order, diligently and correctly.
Among other aspects, you agree not to make illegal copies of the content displayed on the Platform, disseminate the content, reproduce it outside the Platform, take screenshots, or any other act that involves fixing, distributing, or making available to the materials hosted on the Platform.
You also agree not to use the registered trademarks of the Platform or any other exclusive industrial property right of ours.
In the event that you decide to purchase tickets through the Platform, you must also read and accept the Contract Conditions relating to the purchase of tickets.
IV.- HOW FAR DOES OUR RESPONSIBILITY REACH?
In order to offer you the Platform there are different elements that must be taken into account; for this reason and by way of explanation, we detail which aspects do not depend on us and therefore will not be our responsibility, directly or secondarily:
Illegitimate uses that users may make of trademarks, names of products or services, or in general, of any industrial property right of a third party.

V-.USE OF COOKIES
We wanted to leave the most technical part for the end; As you surely know, cookies are small pieces of information that are stored in the terminal of the visiting user of the Platform through their browser. Through this policy, crocantickets SL, informs the users of the powertik website (hereinafter "the website") of its Privacy Policy and describes what data it collects, how it uses it, the options of the users in relation to this data, your rights, the security of your data, commercial communications and the modification of the confidentiality policy.

You are solely responsible for anything that happens as a result of your failure to maintain such security and confidentiality.
Purchase of Tickets: Manage the contracting of the products and services offered through the Website or by telephone, as well as for the management of the contractual relationship between the platform and the Users. During the contracting process, financial data (bank cards) may be collected in order to communicate them to the entities that manage the collection. Said purpose responds to the free and legitimate acceptance of the legal relationship between the User and the platform that implies the connection of this treatment with third-party files for the fulfilment of the specified purposes.
Access to the private area: Manage the registration and subsequent data that Users could generate through said area in order to carry out the general administration of their account, maintenance, control, as well as the management of their relationship with the platform.
Buyers: The data provided by users at the time of making the purchase will be made available to the promoters for future communications. Provided that it has been expressly accepted, said data may be used for the purposes of commercial communications by the organiser of the event, and the owners of the platform and its technology.
Promoter pages: All the data provided through contact forms established in the spaces for the promoter will be displayed not only by the promoter, but also by the platform.

We collect information that falls into two general categories:
Information that you provide us.
The platform collects and requests certain personal data for the use and proper functioning of the website. Without this data, it is possible that all the requested services cannot be provided.

When you access our website, we collect information about the use by the User of the Website, since when browsing, data can be obtained about your IP address, the type of browser, the time of access and the addresses of the websites from which you the User has accessed, as well as the browsing data. Collecting such information allows the platform to adapt the content, offer and navigation of each User to improve our services and their experience on the Website.
User rights
The User may exercise the rights of access, rectification, deletion, opposition, portability and limitation, by contacting the platforms, by email hello@powertik.com, or by sending written communication to the following postal address: Henri Dunant, 15-17 - 28036 (Madrid). proving your identity with a scanned copy of your ID or equivalent document, and specifying the right you wish to exercise.
The platform informs its Users of the possibility they have to file a claim with the Spanish Agency for Data Protection in case they understand that the correct assistance has not been obtained in the exercise of the rights mentioned in this section.
Transfer of Data with third parties
The personal data of the Users may be accessed by both third parties or collaborators who provide services to the platform as well as the organisers of the events that the latter attends in order to manage the provision of services, to contact the User in case the event suffers some type of modification, as well as to comply with any legal requirements.
How do we protect your personal information?
We are committed to protecting your personal information. We use appropriate technical and organisational measures to protect your personal information and privacy, and we review these measures periodically. We protect your personal information through the use of a combination of both physical and computer or logical security controls, including access controls that restrict and manage the way in which your personal information and personal data is processed, administered and managed.
Conservation period
The platform informs its Users that their personal data will be kept for the time strictly necessary for the purposes of the treatment for which they have been provided, provided that the User has not revoked their consent and, in any case, following the principle of data minimisation contemplated in the applicable regulations.
In case of exercising your right of deletion, your data will be blocked and kept in a restricted manner available to the competent authorities during the time and for the legal purposes established in the applicable regulations to attend to possible responsibilities arising from the treatment. Minors
In general, in order to use the Website, minors must have previously obtained the authorisation of their parents, guardians or legal representatives, who will be responsible for all acts carried out through the Portal by minors under their care. In those Services in which it is expressly indicated, access will be restricted solely and exclusively to those over 14 years of age
Applicable legislation and jurisdiction
The applicable law in case of dispute or conflict of interpretation of the terms that make up these Conditions of Use, as well as any matter related to the Portal services, will be Spanish law.
For the resolution of any dispute that may arise from the use of the Portal and its services, the parties agree to submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, and their hierarchical superiors, expressly waiving other jurisdictions if they had them and were different from those reviewed.
